G v G  - Breakdown of marriage/property settlement/long marriage
September 2010

Watson & Watson acted on behalf of the Wife.

There was a long marriage of approximately 20 years and there were significant assets, however, there were very substantial debts and the total net assets were significantly less than the value of the former matrimonial home which was an average home in the suburb in which it was located.

If the matter was litigated with the significant assets requiring valuation, there would be an insignificant sum available for distribution between the husband and wife. The wife would have a sum significantly less than the sum that would be required to enable the wife to purchase even a very much reduced accommodation in the same area.

By negotiation and without incurring very substantial legal fees and valuation and other fees, Watson & Watson negotiated a position for the sale of the former matrimonial home and the purchase of suitable accommodation for the wife and children in the same district.

Such resolution would never have been available in a litigated matter.
