Watson & Watson Family Lawyers understand that your children mean more than anything to you. We’ll do our best to make sure you get a fair share in your children’s upbringing. Under family law, each parent is presumed to have parental responsibility for a child. But the details of care, contact and child support are your decision – or the Court’s. We can assist you and your former partner to develop a formal parenting plan, an agreement covering your child’s residence, contact, and maintenance.

Otherwise, courts have the power to make parenting orders, on the application of either parent, a child’s carer, or the child itself. Although the primary consideration is the best interests of the child, the court will make its decision based on a wide variety of factors, such as the child’s relationship with each parent, parental attitudes, and capacity to provide.

Once an order is in force, a breach may constitute abduction. The court can issue a warrant for the child’s recovery or the offender’s arrest.

On occasions, there is a need to move very urgently, for example, to prevent a child being taken from the country. Watson & Watson has undertaken such applications and recently obtained a judgment within 2 hours, preventing a child leaving the country, such an order being obtained close to 9 pm at night. Not all matters are this urgent. However Watson & Watson has the knowledge, ability and practice to consider advice and obtain the urgent orders when needed.
